What types of cases count as personal injury?

In Florida, personal injury encompasses a broad range of case types, including slip and falls, car crashes, defective products, wrongful deaths, and more. What is the statute of limitations for personal injury cases in Florida?

Two years from the date of the accident for most personal injury cases. The signing of HB 837 on March 24, 2023 shortened the statute of limitations from four years to two years, along with instituting a series of other tort reforms. If your injuries occurred on or before March 24, 2023, you may still have time to file your lawsuit. Claims against government agencies or those involving defective products have separate statutes of limitations. What type of damages can I receive compensation for in a personal injury case?

You can receive compensation for economic and non-economic damages. These cover the harm that was caused by the other party’s negligence. In rare cases you can also seek punitive damages. These are designed to punish a party that was particularly reckless. Economic damages involve direct monetary costs borne by the victim; these include medical bills, future medical care, lost wages, and diminished earning capacity. Non-economic damages cover personal losses that are more difficult to quantify but no less real; these include pain and suffering, loss of enjoyment of life, and loss of consortium.
